Electronic Health Records (EHR) & Meaningful Use: Training & Certification

The American Recovery and Reinvestment (ARRA) Act which is also termed as the stimulus package was passed as law on February 17, 2009 and can be cited in the Public Law section 111-5. In addition, the ARRA added incentives with the objective of reinforcing the use of electronic Health records by critical access hospitals, hospitals and specific healthcare professionals.

The EHR upgrade incentives and its associated requirements were outlined in the Division B, Title IV sections. These incentives that were outlined in the Title IV became available at the beginning of Federal Fiscal year (FY) 2011 or on 10 January 2010 for CAH’s and Hospitals. However, for the EP the financial incentives became available in the calendar year (CY) 2011. Most importantly, if a CAH, Hospital or EP failed to upgrade their system to EHR and its meaningful use measures by 2015 for CAH’s and hospitals while the CY for EPs then reimbursements from the Center for Medicare and Medicaid Services (CMS) shall be reduced.

The CMS drafted and finalized the Meaningful Use Rule which outlines the “Meaningful use” of the EHR. Furthermore, the rule also included some of the relevant requirements needed to be met for an entity or hospital to qualify for Medicare/Medicaid EHR financial incentives.

However, the rule being used today consists of the Stage 1 requirements thus there are three stages of measurements needed to be met for one meet the requirements of meaningful use. As the stages of meaningful use progress the requirements become more stringent with stage 2 having been delayed to 2014 while for stage 3 will be effective on the TBA date.

On March 5, 2012 the Stage 2 meaningful use of proposed draft rule or rulemaking (NPRM) and Vendor Stage 2 EHR Application requirements of the draft rule or NPRM was published in the Federal register. Furthermore, this publication of the draft rule or NPRM is normally followed by 60 day public comment period and during this period the comments are basis for areas that need revision in the draft before the publication finalization. Once the rules have been finalized they will be of great implication to the meaningful use measure and vendor functional or technical requirements and these rules must be made before being issued the federal certification.
